Obama’s Gun-Control Orders Contains a BAN on Guns for Some Social Security Beneficiaries

It’s Obama’s last year in office, and he is completely unplugged…from the Constitution. His executive actions on gun control today inflict broad damage on the Second Amendment and the People’s right to bear arms.

But if you are a Social Security recipient, there is an outrageous provision that should leave you fighting mad.

Because it may well completely bar you from owning a gun.

The White House released a fact-sheet Jan. 4 which previews the executive gun control Obama will unveil Tuesday and one aspect of the new controls is the inclusion of “information from the Social Security Administration in the background check system about beneficiaries who are prohibited from possessing a firearm.”

On July 18 Breitbart News reported on Obama’s push to ban gun-possession for Social Security beneficiaries who are believed incapable of handling their own finances.

At that same time, the Los Angeles Times reported that a ban was being put together “outside of public view,” so all the details were not known. But the Times did  know that the ban would cover those who are unable to manage their own affairs for a multitude of reasons–from “subnormal intelligence or mental illness” to “incompetency,” an unspecified “condition,” or “disease.”

The ban pertaining to Social Security beneficiaries is now tucked into the “mental health” aspects of Obama’s executive gun control.

According to the White House executive order preview:

Current law prohibits individuals from buying a gun if, because of a mental health issue, they are either a danger to themselves or others or are unable to manage their own affairs. The Social Security Administration (SSA) has indicated that it will begin the rulemaking process to ensure that appropriate information in its records is reported to NICS. The reporting that SSA, in consultation with the Department of Justice, is expected to require will cover appropriate records of the approximately 75,000 people each year who have a documented mental health issue, receive disability benefits, and are unable to manage those benefits because of their mental impairment, or who have been found by a state or federal court to be legally incompetent. The rulemaking will also provide a mechanism for people to seek relief from the federal prohibition on possessing a firearm for reasons related to mental health.

Social Security beneficiaries who meet the criteria of “mental impairment” as demonstrated by a partial inability to handle their own benefits will be added to the National Instant Criminal Background System, therefore they will no longer be able to purchase a gun.

According to GunWatch, this one section could keep guns out of the hands of “millions” of Americans who have complete use of their mental faculties but still meet this broad criteria.

The tyrant Obama is throwing the Bill of Rights into the White House fireplace today.

      I have tried to call my Senator ( Democrat ) and Representative ( Republican ) and get a answering machine. I express my opinion but never receive a word from the other end. They do not listen to anyone, they have their own opinion and thoughts about what is best for us instead and that is the way they vote on a bill, Or it may be they are paid a lot of money to vote the way they do. I have not seen a bill passed that has benefited the regular US citizen for decades now. I feel like I’m wasting my breath and time.

          I was talking about telephoning not a petition drive, braidbrain2. But if you think that would change the way this government works and does business I’m all for it, I really hope it would make a difference. But I really have my doubts about it working if it is true what I see, they work for ans pass laws for the people that finance their campaigns as well as make them wealthy while in office, they are the people that get the favorable legislation, not the regular US citizen. Is the tax codes far, is it far that the Seniors on Social Security and veterans get no raise this year and billions is spend on take care of people that are not US citizens, this government spends 43,000,000 dollars on a four pump gas station that is not used and I think there was 11 to be built. A 17,000,00 dollar gift to banks. Repealing a tax on the very wealthy when they pass their business and mansions to their children. I watch as many different news programs, cspan, that I can and read as much as possible about what is going on in this country and the world as I can. But this has happened with Republican congress as well as a Democrat administration. I look back at government for decades. This country has been heading in the wrong direction for many years, it does not matter what political party has been in charge. So lets try your way , I hope it works.

      Not to mention people that have been prescribed antidepressants, to help treat fibromyalgia, which has nothing to do with being depressed or having mental issues. The government will not dig any deeper then they have to, thus rendering people ineligible to purchase a firearm, unless they hire a lawyer costing them big money, with only a hope and a prayer that the government changes their stance.

    How can this alleged POTUS infringe on the Rights of those who draw social security or have Medicare/Medicaid without anyone stepping up to contest these Unconstitutional actions. How many social security recipients have been involved in “mass shooting,” rampant criminal acts involving the use of a firearm or other atrocious acts. If find it somewhat hard to rob a bank from a wheelchair or while using a walker of some sort. I can’t even imagine a “mad bomber” walking with the assistance of an aide trying to secrete a bomb to cause mass casualties. It’s even harder to imagine a person on SS working in his/her garage or attic late at night constructing such a weapon. Oh yea, how about jumping out of a cab on a busy intersection and opening fire as his/her aide gets his walker or cane out for support in holding the weapon. This is not only ridiculous but just goes to show how far out of touch this POTUS and his minions are out in “left” field. The Supreme Court better get their “pens” ready for the onslaught that is sure to come from this simpleton act.

  • All laws, regulations, EO’s, and international agreements attempting Arms (the Constitution’s terminology) ownership restrictions are done under the color of law and of no effect.

    The Second Amendment is clear,” The right of the people to keep and bear Arms, shall not be infringed.” Any attempts to restrict this absolute Right of all the people is usurpation.


    Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.

    For the purpose of Section 242, acts under “color of law” include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official’s lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials.

    The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury.


    Unconstitutional Official Acts

    16 Am Jur 2d, Sec 177 late 2d, Sec 256:

    The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be In agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:

    The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it’s enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

    Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it…..

    A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.

    No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.


  • Boston – National Guard units seeking to confiscate a cache of recently banned assault weapons were ambushed by elements of a Para-military extremist faction. Military and law enforcement sources estimate that 72 were killed and more than 200 injured before government forces were compelled to withdraw.

    Speaking after the clash, Massachusetts Governor Thomas Gage declared that the extremist faction, which was made up of local citizens, has links to the radical right-wing tax protest movement.

    Gage blamed the extremists for recent incidents of vandalism directed against internal revenue offices. The governor, who described the group’s organizers as “criminals,” issued an executive order authorizing the summary arrest of any individual who has interfered with the government’s efforts to secure law and order.

    The military raid on the extremist arsenal followed wide-spread refusal by the local citizenry to turn over recently outlawed assault weapons.

    Gage issued a ban on military-style assault weapons and ammunition earlier in the week. This decision followed a meeting in early this month between government and military leaders at which the governor authorized the forcible confiscation of illegal arms.

    One government official, speaking on condition of anonymity, pointed out that “none of these people would have been killed had the extremists obeyed the law and turned over their weapons voluntarily.”

    Government troops initially succeeded in confiscating a large supply of outlawed weapons and ammunition. However, troops attempting to seize arms and ammunition in Lexington met with resistance from heavily-armed extremists who had been tipped off regarding the government’s plans.

    During a tense standoff in the Lexington town park, National Guard Colonel Francis Smith, commander of the government operation, ordered the armed group to surrender and return to their homes. The impasse was broken by a single shot, which was reportedly fired by one of the right-wing extremists.

    Eight civilians were killed in the ensuing exchange.

    Ironically, the local citizenry blamed government forces rather than the extremists for the civilian deaths. Before order could be restored, armed citizens from surrounding areas had descended upon the guard units. Colonel Smith, finding his forces over matched by the armed mob, ordered a retreat.

    Governor Gage has called upon citizens to support the state/national joint task force in its effort to restore law and order. The governor also demanded the surrender of those responsible for planning and leading the attack against the government troops.

    Samuel Adams, Paul Revere, and John Hancock, who have been identified as “ringleaders” of the extremist faction, remain at large.

    And this fellow Americans, is how the American Revolution began, April 20, 1775.

    One thing people are overlooking is the backdoor elimination of your rights. Not just the Second, but the Fourth as well. Glorious Leader wants anyone selling a weapon privately to obtain an FFL. Anyone holding an FFL is subject to having his home and business searched by the BATF at any time, for any reason, without a warrant.

    Unsurprising, as they already have banned VA patients for any number of criteria. My in-laws received a letter from the government threatening them with imprisonment if they didn’t get rid of their guns because my father-in-law has Alzheimers. So despite the fact that my Mother-In-Law could prove he had no access to a firearm (they were locked in a safe he didn’t know the combination to) they said they had to get rid of their guns. They have left my mother-in-law defenseless in her own home. It’s unconscionable.

My opinion is that people who do not have the mental faculty to be able to take care of their own finances have no business with any firearms. This is a no brainer.

    I take Xanax and have for years because it stops nightmares I have had since a child. I also take oxycodone for pain from fusing Lumbar 2 through L5 .

      The president is granted certain actions that allows him to do anything he sees fit as long as it does not violate the constitution or laws established by the legislature. Executive action is his tool for developing actions. Obama himself is a constitutional law attorney and has been able with advisors to stretch his limit to almost tipping point, but staying in within his limits.
      He has not done anything traitorous, yet. He is acting within his political ideology, although they differ from yours or mine, this does not make it illegal. The first amendment allows us to all express our ideas and thoughts. Furthermore, while the basics of liberal economic policy resemble communism, he is still not communist. Bernie sanders is more socialist than him. Therefore, he can be impeached for almost anything congress sees fit but the support for this in congress is not enough.

    You are all overlooking the obvious… The law right now, as it is, without Obama, already says “Current law prohibits individuals from buying a gun if, because of a
    mental health issue, they are either a danger to themselves or others or
    are unable to manage their own affairs.” That’s a quote from the article above itself. Not something I dug up elsewhere. The exec order is asking for some streamlining of information from the SSI department to help identify such people because some SSI recipients are on SSI specifically because they’re mentally screwed up.
    Let’s face it, folks The main reason that people on the left are so anti-gun is because nutjobs get guns and use them on innocent people. The fewer of these nuts that go shooting things up, the less I have to worry about public pressure causing me to lose my ability to carry. Given the right combination of events and the right timing, there’s no reason the second amendment couldn’t itself be amended to prohibit it.

    Similarly, federal law already requires anyone engaged in the business of selling firearms to get an FFL and conduct background checks. So basically the order is asking the ATF to stop ignoring people who are doing business without a license. Hell, some of these people at gun shows have 2-3 people working and taking credit cards over mobile phones. That’s certainly “engaging in the business of selling firearms” and they’re competing unfairly with real brick and mortar shops.

    Late last year Mr. Obama informed the people inhabiting our beautiful blue orb that American recording artist and Grammy winner Kendrick Lamar wrote one of his favorite musical performances of 2015.

    During a January 20, 2011 LAWeekly interview (Google search) Kendrick, born in 1987, the same year songwriter Suzanne Vega wrote a song about child abuse and *VICTIM DENIAL* that was nominated for a Grammy award, he told the interviewer:

    *”Lamar’s parents moved from Chicago to Compton in 1984 with all of $500 in their pockets. “My mom’s one of 13 [THIRTEEN] siblings, and they all got SIX kids, and till I was 13 everybody was in Compton,” he says.”*

    *”I’m 6 years old, seein’ my uncles playing with shotguns, sellin’ dope in front of the apartment.”*

    *”My moms and pops never said nothing, ’cause they were young and living wild, too. I got about 15 stories like ‘Average Joe.'”*

    I am curious to know if Mr. Obama believes the adult members of Kendrick Lamar’s family are the “VIOLENT FELONS” he wishes to protect peaceful people from?

    Kendrick writes and speaks in public about childhood and adult depression, as well as having suicidal thoughts.

    What has Mr. Obama done to protect children like young Kendrick and untold numbers of other kids who were deprived of experiencing and enjoying a safe, ‘Average Joe’ American kid childhood by the CRIMINAL MINDED parents who MALTREAT children like Kendrick, his three siblings and numerous cousins by exposing them at an early age to destructive anti-social behaviors and criminal environments?

    Which values do children like Kendrick, his siblings, cousins, classmates and friends embrace, their family and neighborhood values or the peaceful values their frustrated educators attempt to instill in MALTREATED children like Kendrick?

    Is it time to flush “America’s War on Poverty” correctly renaming it to “America’s War on Early Childhood Abuse & Neglect!”
